Summary:

The City has received Zoning Map Amendment Application to rezone properties identified as parcels 11111000G0003B, 03A, 04B, 04A (totaling +/-1.32 acres), which is located on the corner of South State Street and West 6th Avenue. Frank Wolfe (applicant and property owner) is requesting the rezoning from Traditional Neighborhood District to Mixed-Use District. Rezonings are legislative decisions and require staff review, Planning Board review and recommendation, and City Council adoption of an ordinance following a public hearing.

The subject properties are located approximately one block north of South Main Street and are situated within an established area characterized by a mix of residential, office, and higher-density residential development. Bellamy Apartments, a high-density residential development, are located immediately to the east, while renovated residential structures currently utilized as offices and single-family dwellings are located throughout the surrounding area. Given the established pattern of development and the existing mix of residential and commercial uses in the immediate vicinity, Mixed-Use District zoning is consistent with and appropriate for the character and land-use pattern of the surrounding area. The proposed zoning would provide an appropriate transition between the higher-density and commercial uses along the South Main Street corridor and the established residential neighborhoods surrounding the subject properties. It would also allow for a logical continuation of the existing mixed-use development pattern rather than introducing a land-use intensity that is inconsistent with the area.

Importantly, any future commercial development on the subject properties would remain subject to the applicable requirements of Article 4, Development Regulations, including required impact buffers and additional development standards for commercial uses located adjacent to residential properties. These requirements provide regulatory safeguards to address potential impacts such as site design, buffering, and the transition between commercial and residential uses.

In accordance with the North Carolina General Statutes, the Planning Board and City Council must adopt a Statement of Consistency and Reasonableness for any rezoning request in relation to the adopted 2022 Land Use Plan. While the applicant has not identified a specific proposed development or use as part of this rezoning request, the proposed zoning district would allow a variety commercial uses and higher density residential developments. Based on staff analysis, a suggested statement of consistency and reasonableness for Planning Board and City Council approval is as follows: “The proposed Zoning Map amendment is consistent with the 2022 Land Use Plan, which states that “A variety of commercial and service uses that meet the daily needs of residents, while not negatively impacting the community as whole will be supported. Increase in the variety of grocery stores, restaurants, retail, and entertainment offerings are encouraged”. This property has been posted and adjoining property owners were mailed notification of the Planning Board meeting and will be notified prior to the Public Hearing at City Council.
