Summary:
On December 31, 2025, the City of Lexington received a petition for voluntary annexation from petitioner Bruce R. Hubbard President of HRWS Investments, LLC, previously knowns as Hubbard Realty of Winston-Salem, Inc., to annex one parcel containing 424.326 acres located along Front Street and Old Salisbury, Cow Palace, and Tyro Roads. The subject property is identified by the Davidson County Tax Department as Parcel Number 1802700000008 and PIN 6704-03-34-4508. The property is contiguous to the city limits and petitions for voluntary contiguous annexation are regulated by NC General Statutes 160A-31.
Based on conversations with the petitioner, the property is intended to be used for residential development. The assignment of a zoning district by City Council will follow adoption of the ordinance to approve the annexation. The current Davidson County zoning district for the property is identified as: RA-1, Rural Agricultural District.
On January 12, 2026, City Council voted unanimously to adopt Resolution 2026-003 directing the City Clerk to investigate the sufficiency of the petition to ensure it meets statutory requirements. Upon investigation it was determined that the petition appears to be valid and meets all requirements.
On September 28, 2026, City Clerk Certified a Sufficiency of Annexation and City Council adopted City Council Resolution 2026-031 Setting Date for Public Hearing for Annexation for October 12, 2026.
On September 30, 2026, City Clerk issued a notice of public hearing in the Winston Salem Journal and on Saturday, October 3, 2026, the City Clerk issued a notice of public in The Dispatch.
On October 1, 2026, City Clerk provided annexation notification to Davidson County Clerk to the Board of Commissioners and the Interim Davidson County Manager.
The voluntary annexation process involves several steps. First, City Council determines whether there is interest in considering the annexation. If there is no interest, Council simply denies. If there is interest, City Council would adopt a resolution directing the City Clerk to investigate the sufficiency of the petition to ensure that it meets statutory requirements. One of the criteria in meeting the statutory requirements is that the City must be able to provide services to the property in the same manner and to the same level of service as provided within the municipal corporate limits. Following adoption of said Resolution, various departments will be asked to evaluate and certify to the Clerk that the City is able to provide services to the property as required. Then, the City Clerk certifies that upon investigation the petition appears to be valid. Next, a public hearing is scheduled and the notice is published in a local newspaper. City Council then holds the public hearing to receive public input. Following the public hearing, Council considers adoption of an Ordinance to annex the identified property. Upon adoption the annexation is effective immediately.
It is at the sole discretion of City Council as to whether it is interested in pursuing petitions for annexation. Cities are under no obligation to annex property and service level impacts must be considered relative to potential revenues.
It is important to note Session Law 2022-24/Senate Bill 907 and the act was effective on June 30, 2022; Set forth by SECTION 4. This act does not apply to annexation of any property to be used for single-family residential or multi-family residential purposes.
