Summary:

The City has received Zoning Map Amendment Application to rezone property identified as parcel 1104500000003, which is located on the corner of Holly Grove Road and Martin Luther King Jr. Boulevard. Kirk W Clinard (applicant and property owner) is requesting the rezoning from Traditional Neighborhood District to Business District. Rezonings are legislative decisions and require staff review, Planning Board review and recommendation, and City Council adoption of an ordinance following a public hearing.

The subject property is identified by the Davidson County Tax Department as Parcel Number 1104500000003, which is 3.69 acres and is owned by Kirk W. Clinard. The property is currently zoned Traditional Neighborhood District and is identified as parcel 1104500000003, which is located on the corner of Holly Grove and Martin Luther King Jr. Blvd.  The request is to rezone the parcel to Business District to better align its location along Martin Luther King Jr. Blvd with the adjacent commercial uses along the western side.

Martin Luther King Jr. Blvd is a major thoroughfare into the City and is predominantly lined with a mix of commercial, retail, and residential uses. Davidson Plaza, along with other standalone commercial properties, is located on the western side of Martin Luther King Jr. Blvd. Given the property's location and the way this corridor has developed, Business District zoning is appropriate for the surrounding uses. Any proposed commercial development will be subject to the standards of Article 4, Development Regulations, which include required impact buffers and additional development standards for commercial properties adjacent to residential uses. The proposed zoning would also be consistent with the surrounding area’s zoning, which includes Business District zoning to the west and Traditional Neighborhood District zoning to the east. A complete list of permitted uses within the Business District is attached for reference.

In accordance with the North Carolina General Statutes, the Planning Board and City Council must adopt a Statement of Consistency and Reasonableness for any rezoning request in relation to the adopted 2022 Land Use Plan. While the applicant has not identified a specific proposed development or use as part of this rezoning request, the proposed zoning district would allow a variety commercial uses and higher density residential developments. Based on staff analysis, a suggested statement of consistency and reasonableness for Planning Board and City Council approval is as follows: “The proposed Zoning Map amendment is consistent with the 2022 Land Use Plan, which states that “A variety of commercial and service uses that meet the daily needs of residents, while not negatively impacting the community as whole will be supported. Increase in the variety of grocery stores, restaurants, retail, and entertainment offerings are encouraged”.

This property has been posted and adjoining property owners were mailed notification of the Planning Board meeting and will be notified prior to the Public Hearing at City Council.
