Summary:

In order to close N.C. Department of Transportation (NCDOT) maintained streets for parades and festivals, cities and counties are required to adopt an ordinance affirming the City will accept responsibility for, and liability related to, the parade or event by the passage of an ordinance.  The purpose of this ordinance is evidence that the City will accept responsibility for, and liability related to the parade or festival. If the event is an annual re-occurring event, the ordinance can be adopted once for all future events unless there is a change.  The City will be responsible for safety, traffic flow, traffic control, appropriate signage, and ensure that all debris, litter, decorations, and other items associated with the event are removed following the event.

Upon adoption by City Council, a copy of the Ordinance will be forwarded to the local Highway Division office for its records and NCDOT will verify the event does not interfere with any maintenance activities or other special events.  Partners will have liability insurance, naming the City of Lexington as additional insured.
